Welcome to Pophie! These Terms of Service ("Terms") govern your access to and use of the Pophie desktop AI companion device, companion software applications, cloud-based features, content services, firmware updates, and all related services (collectively, the "Services") provided by INSBOTICS TECHNOLOGY PTE. LTD. ("Company," "we," "us," or "our").
By activating, setting up, or using the Services, you agree to be bound by these Terms. If you do not agree, do not activate or use the Services and refer to our return policy for eligible returns. These Terms, together with our Privacy Policy and any applicable warranty, return, or subscription terms published by us, form the complete agreement governing your use of the Services.
If you are under the age of majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian. If you are under the applicable age of digital consent in your jurisdiction, your parent or guardian must provide verifiable consent.
1. Product Description
Pophie is a desktop interactive companion device powered by generative artificial intelligence and related technologies, capable of voice interaction, visual perception, motion feedback, and other features.
Outputs generated by Pophie — including text, speech, motion, lighting, images, or other responses — are produced by algorithms in real time. Pophie does not possess consciousness, emotions, sentience, or legal personhood.
Certain features require an internet connection, cloud services, or third-party services. These features may be limited, delayed, or unavailable during network outages, cloud service interruptions, or third-party service changes. Details regarding connectivity requirements are provided on our product pages, user manual, and within the companion app.
2. Account and Activation
You must provide accurate and complete information when activating or registering the device. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You may not use the Services for commercial resale, bulk automation, unauthorized API access, or any activity that disrupts the normal operation of the Services, unless expressly authorized by us in writing.
3. Use Guidelines and Safety
3.1 General Use
You must use Pophie in accordance with the product manual, safety instructions, and compatible power supply requirements. Do not intentionally drop, crush, submerge, disassemble, modify, or tamper with the device or bypass any safety mechanisms.
3.2 Physical Safety
Pophie may produce voice, light, screen, or mechanical motion feedback during interaction. Do not place fingers, hair, clothing, or other objects near moving parts. Keep the device away from high temperatures, liquids, fire, flammable materials, table edges, infants, and pets. Minors should use Pophie under adult supervision.
The device generates heat during operation and charging. Do not block ventilation or heat-dissipation areas. Do not operate the device while covered, wrapped, or enclosed, or in high-temperature, poorly ventilated, or confined environments. If you notice abnormal heat, odor, smoke, deformation, or unusual noise, stop using the device immediately and contact support.
3.3 Plush Cover and Accessories
If your Pophie includes a plush cover, fabric garment, or other wearable accessory, follow the care instructions provided with the product. Do not machine wash, soak, tumble dry, bleach, or expose the cover to prolonged direct sunlight unless the instructions expressly permit doing so. Improper removal, reattachment, washing, or alteration of the plush cover — or use of unauthorized third-party covers or accessories — may cause overheating, sensor obstruction, joint obstruction, or device damage, and may void warranty coverage.
3.4 Cameras and Microphones
Pophie is equipped with cameras, microphones, and other sensors. You are responsible for using these features in compliance with all applicable laws. Do not use Pophie to infringe on the privacy, image rights, or other legal rights of any third party, and do not use the device in private spaces without proper authorization.
3.5 Prohibited Conduct
You may not use the Services to:
- Generate, distribute, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
- Infringe any intellectual property, privacy, or other rights of any third party;
- Attempt to elicit outputs that promote illegal activity, violence, discrimination, or exploitation;
- Interfere with or disrupt the integrity or performance of the Services;
- Reverse engineer, decompile, disassemble, or extract code or data from the Services, except as expressly permitted by applicable law;
- Engage in any conduct that violates applicable law or these Terms.
4. AI-Generated Content
Outputs from Pophie are generated by artificial intelligence algorithms and may be inaccurate, incomplete, delayed, inconsistent, or different from what you expect. All outputs are provided for general informational and interactive purposes only.
Pophie's outputs do not constitute medical, psychological, legal, financial, educational, emergency, or any other professional advice and should not be relied upon as the sole basis for any decision. If you need professional guidance, consult a qualified professional.
We implement content safety measures in accordance with applicable laws and regulations. If you encounter any output that you believe is unlawful, harmful, infringing, or otherwise inappropriate, please report the output to us at support@pophie.com.
5. Intellectual Property
5.1 Our Rights
All intellectual property rights in the Services — including hardware design, software, firmware, AI models, virtual characters, voice profiles, interaction logic, trademarks, and trade secrets — belong to us or our licensors.
5.2 Your Content
You retain all rights in the content you upload, input, or submit through the Services ("Your Content"). By using the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, store, and use Your Content solely as necessary to provide, maintain, secure, and improve the Services, subject to our Privacy Policy.
5.3 Model Training
If we wish to use Your Content, conversation history, or personalized interaction data for model training, dataset development, public display, or any purpose beyond providing the Services, we will seek your separate consent or provide a clear opt-out mechanism, as described in our Privacy Policy.
5.4 AI Outputs
Ownership and rights in AI-generated outputs are determined by applicable law and the specific context of use. These Terms do not automatically assign all intellectual property in generated outputs to the Company.
6. Content Moderation, Restrictions, and Appeals
We may review your use of the Services and take action if we reasonably believe you have violated these Terms or applicable law, including removing content, restricting features, suspending or terminating your account, or other measures as appropriate.
Where practicable, we will notify you of the reason for any action taken. You may appeal any such decision by contacting us at support@pophie.com. We will review appeals within a reasonable timeframe.
7. Privacy and Data Protection
Your privacy matters to us. The collection, use, storage, sharing, transfer, deletion, and protection of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms. If any conflict exists between these Terms and the Privacy Policy regarding personal data, the Privacy Policy prevails.
Your use of the Services may be subject to additional data protection rights under the laws of your jurisdiction. Please refer to our Privacy Policy for details on how we collect, use, and protect your data, including how to exercise your rights regarding your personal information.
8. Warranty, Returns, and Hardware Maintenance
The following situations are not covered under any free warranty or return program:
- (a) Use not in accordance with the product manual, safety instructions, or power supply requirements;
- (b) Use of incompatible or unauthorized power adapters, cables, or accessories;
- (c) Unauthorized disassembly, modification, repair, or tampering;
- (d) Damage from drops, water, moisture, liquid exposure, fire, excessive force, impact, pet damage, or other external or human-caused factors;
- (e) Overheating, performance degradation, or damage caused by blocking ventilation, covering the device, or operating in high-temperature, confined, or poorly ventilated environments;
- (f) Damage, soiling, shrinkage, discoloration, deformation, unraveling, shedding, joint obstruction, sensor obstruction, or overheating caused by user removal, reattachment, washing, alteration, or modification of the plush cover, garment, or accessory, or by use of unauthorized third-party covers or accessories;
- (g) Normal wear and tear, soiling, or aging of plush covers, fabric, decorative elements, and other consumable or cosmetic components;
- (h) Other use beyond normal and reasonable conditions.
Even if not covered under a free warranty, we may offer paid repair or support options.
9. Service Changes, Suspension, and Termination
9.1 Changes to Services
We may update, maintain, adjust, or discontinue any part of the Services for business, technical, legal, security, or operational reasons.
For routine maintenance or minor adjustments, we will make reasonable efforts to provide advance notice or timely explanation. For material changes to core features, pricing changes, or permanent discontinuation, we will provide advance notice through the companion app, our website, email, or other reasonable means.
9.2 Discontinuation Protections
If we permanently discontinue the Services or a core paid feature, and this affects a service you have already paid for but not yet fully received, we will provide a pro-rata refund, equivalent replacement, or other reasonable compensation.
Where technically feasible and legally permitted, we will provide data export, migration assistance, or a reduced-functionality offline mode, including but not limited to conversation history and personalized interaction data.
9.3 Suspension or Termination for Cause
We may suspend, restrict, or terminate your access to the Services if you violate these Terms or applicable law. Where practicable, we will notify you of the reason. You may appeal by contacting support@pophie.com.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. We do not warrant that all outputs will be accurate, complete, consistent, or free from error, or that the Services will be uninterrupted or secure.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, DEFECTIVE PRODUCTS UNDER MANDATORY PRODUCT LIABILITY LAW, OR YOUR MANDATORY STATUTORY CONSUMER RIGHTS.
12. Minors
We are committed to protecting minors. Minors should use Pophie under the guidance and supervision of a parent or guardian. Guardians should help minors understand the nature and limitations of AI products and prevent excessive reliance, overuse, or use in inappropriate settings. 13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services, our website, or by email. The updated Terms take effect on the date stated. If you do not agree to the updated Terms, you may stop using the Services. Your continued use after the effective date constitutes acceptance.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If the dispute cannot be resolved amicably, either party may submit the dispute to the competent courts, except where mandatory local consumer protection law grants you the right to bring proceedings in your local courts. Nothing in this section deprives you of any mandatory consumer protection rights under the laws of your jurisdiction.
15. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy and any applicable warranty, return, or subscription terms, constitute the entire agreement between you and the Company regarding the Services.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to an affiliate or successor without your consent.
